Terms & Conditions

The following terms and conditions apply to all transactions on the Mad About Fancy Dress website. At checkout, you will be asked to agree to these T&C's so please read through these carefully before placing an order.

Use of Website
We cannot guarantee that this website will be compatible with your PC hardware or software and cannot be held responsible for any corruption or loss of data on your PC or any liability for any kind of loss or damage from using this site.

We reserve the right to restrict or terminate without notice your use of this website at our discretion.

Changes to Terms & Conditions
Mad About Fancy Dress is entitled to alter these Terms and Conditions at any time. However, this shall not affect the existing Terms and Conditions accepted by the Buyer at the time of making a purchase.

Product Images & Descriptions
We try to keep our product images & information as up-to-date and accurate as possible. Mad About Fancy Dress holds no liability to inaccurate description or any misconception you may have in product representation. We reserve the right to amend information and pricing at any time without consent or giving notice.

We would like to point out that manufacturers do reserve the right to change the design and colours of items without notice. Your item may therefore differ slightly in design, colour, packaging etc to that shown on our website.

Ordering
No contract will exist between Mad About Fancy Dress and the Buyer until we have confirmed your order by email and that payment has been successfully made.
Please make sure that the email address you provide to us is correct and your mailbox is properly working as your order confirmation and any correspondence will be sent to the email address you provide.

We may cancel, decline or reject an order placed on our website without notice and refund any payment made.
We reserve the right to withdraw any goods from the website at any time and shall not be liable to anyone for withdrawing any goods or for refusing to process an order.

We have made provision on our website to only accept orders for items that are in stock. However, should the item be unavailable for whatever reason, we will notify you and you will be given the option to await further stock or alternatively receive a full refund within 30 days. If we do not have a response from you within 3 days, to avoid delays we will ship an alternative item to you (of the same or higher value) which if unsuitable, you can return for a full refund (including postage costs) subject to our Returns Policy.

Prices
All prices are correct a time of publication. We reserve the right to alter prices or the specification of any item on the website without notice. Once your order has been accepted, we will not change the price that applies to that order.
The prices displayed are inclusive of VAT at the current standard rate of 17.5%. VAT is charged on all sales to customers located within the UK or within another member state of the European Community.
Payment of the price plus VAT and delivery charges must be made in full before dispatch of the Goods.

Offers
We reserve the right to cancel or amend any existing offers / discounts without notice.

Delivery
We do our best to deliver your order in line with the estimated delivery schedule but cannot guarantee a delivery date. If there is a problem in meeting an agreed delivery date, we will notify you and you will be given the option of cancelling for a full refund.

Title and risk of damage to the Goods shall pass to you upon delivery of the goods to the address you specified on your order.

We will not be liable to you for any loss, damage or charge incurred because of the late delivery of goods.

If your costume or items do not arrive in time for your party, you may return the item for a refund in line with our Returns Policy. If it is our error, we will also refund the postage charges but we cannot be held responsible for any delays within the postal service or for customers selecting an inappropriate postal service e.g. 1st class instead of Special Next Day delivery. If the costume/items are needed urgently, we recommend selecting the Special Next Day delivery option.

Complaints

Please direct any complaints in writing to us at the address given on our contacts page.

Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer`s acceptance of these Terms and Conditions.

These Terms and Conditions to not affect your statutory rights as a Consumer.

Faulty goods
If an item is faulty, please let us know as soon as possible so we can provide a replacement if possible. You should advise us within 7 calendar days of receiving the item.
 
Please either let us know by phone or email so we can provide a Returns Number and return the goods to the address on the top of your receipt/invoice including this Returns Number. There may be a delay in processing your refund/replacement if you do not include this information.
We are sorry but we cannot to replace or refund a faulty item until we receive the original back from you.

Damage in transit
If goods are lost or damaged during delivery, it is the responsibility of Mad About Fancy Dress to make a claim for compensation from the carrier but we can only claim up to the maximum amounts covered by the delivery service you choose. We cannot claim for loss until 15 days after date of posting:

Special Next Day delivery up to £500
Parcelforce courier up to £150

* you have the option at checkout to pay for additional insurance

We recommend that you choose a delivery service that will cover the value of your order should it be lost or damaged. We will not accept liability for items lost or damaged in transit but will be glad to make the compensation claim on your behalf. Please note however, that it can take the Royal Mail a few weeks to process these claims and we are unable to pay any compensation to you until we have received confirmation of the claim from the Royal Mail.

If an item is damaged in transit, please report it to us immediately (within 5 days latest) as there is a time limit on when claims can be made. Please keep the damaged item and all packaging as the carrier may wish to inspect it before settling any claim.

Privacy
We at Mad About Fancy Dress treat the information you give us as highly confidential and do our utmost to protect your personal information.

You are however, entirely responsible for protecting your username & password details and we cannot be held responsible for any unauthorised access to your account unless it is a result of negligence on our behalf. If you believe there is a security threat to your password or user details, please contact us immediately so we can change your details.

To process your order and provide a good level of customer service, we will need to know your name, e-mail address, telephone number, and delivery address. We will use this information to keep you up-to-date with the progress of your order, for record keeping and may use them for our own market research purposes.

We will never pass your details onto a third party without your explicit permission, other than for the purpose of processing your order e.g. to credit card companies to clear your payment or to courier companies who will deliver your order. We do not store or have access to your credit/debit card details.

We would also occasionally like to send you promotional offers or information about our products which you may find of interest but if you do not wish to receive this information, you have the option to opt-out at checkout stage.

We only use information that we collect about you lawfully in accordance with the Data Protection Act 1998. We do not sell, rent or pass on any of your details to other parties.

We reserve the right at all times to monitor your use of our website to ensure compliance with these terms and conditions. We also reserve the right to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.

You must not use, reproduce, modify or distribute images or content in any form without our permission.

Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

Your right to cancel
Under the Consumer Protection (Distance Selling) Regulation 2000, you have the legal right to cancel your order within seven working days of receipt of the goods.

However, if your order has already been shipped or processed for shipping, we reserve the right not to refund the postage and packaging charges. If you have already received your order, you must return it to us within 7 working days at your own cost.
